ପ୍ରମାଣ ଅଭାବରୁ ମୃତ୍ୟୁଦଣ୍ଡ ଖାରଜ କଲେ ସୁପ୍ରିମ୍କୋର୍ଟ
ଭୁବନେଶ୍ୱର :୨୦୧୨ ମସିହାରେ ଉତ୍ତରପ୍ରଦେଶର ଜଣେ ଛଅବର୍ଷର ବାଳିକାକୁ ଦୁଷ୍କର୍ମ ଓ ହତ୍ୟା କରାଯାଇଥିଲା। ଏହି ମାମଲାରେ ସମ୍ପୃକ୍ତ ଅଭିଯୁକ୍ତକୁ ଦୁଇଟି କୋର୍ଟ ମୃତ୍ୟୁଦଣ୍ଡାଦେଶ ଦେଇଥିଲେ। କିନ୍ତୁ ୧୦ ବର୍ଷ କାଳ ଜେଲ ଭୋଗିସାରିଥିବା ସମ୍ପୃକ୍ତ ଅଭିଯୁକ୍ତକୁ ସୁପ୍ରିମ୍କୋର୍ଟ ପ୍ରମାଣ ଅଭାବରୁ ନିର୍ଦ୍ଦୋଷରେ ଖଲାସ କରିଦେଇଛନ୍ତି। ସର୍ବୋଚ୍ଚ ଅଦାଲତ ମଧ୍ୟ ତ୍ରୁଟିପୂର୍ଣ୍ଣ ତଦନ୍ତ ଓ ଶୁଣାଣି ପାଇଁ ସମ୍ପୃକ୍ତ ତଦନ୍ତକାରୀ ପୁଲିସ, ତଳକୋର୍ଟ ଓ ଆଲ୍ଲାହାବାଦ ହାଇକୋର୍ଟଙ୍କ ଉପରେ ବର୍ଷିଛନ୍ତି।
ଜଷ୍ଟିସ୍ ଏସ୍ ଅବଦୁଲ ନାଜିର, ଏଏସ୍ ବୋପାନ୍ନା ଓ ଭି ରାମସୁବ୍ରମଣିଆନଙ୍କ ଖଣ୍ଡପୀଠ ଏକ ୪୭-ପୃଷ୍ଠାର ରାୟରେ କହିଛନ୍ତି ଯେ ନାବାଳିକାକୁ ନ୍ୟାୟ ଦେବାକୁ ଯାଇ ଯେକୌଣସି ଲୋକକୁ ଦୋଷୀ ସଜାଯାଇ ପାରିବ ନାହିଁ । ନାବାଳିକା ପ୍ରତି ସାଂଘାତିକ ଅନ୍ୟାୟ ହୋଇଛି ଏଥିରେ ସନ୍ଦେହ ନାହିଁ। କିନ୍ତୁ ଯାହାଙ୍କୁ ଦୋଷୀ ସାବ୍ୟସ୍ତ କରି ମୃତ୍ୟୁଦଣ୍ଡାଦେଶ ଦିଆଯାଇଛି, ତାଙ୍କ ବିରୋଧରେ ସାମାନ୍ୟତମ ପ୍ରମାଣ ନାହିଁ । ଠିକ୍ ଭାବରେ ତଦନ୍ତ ନ କରି ଏବଂ ଠିକ୍ ଭାବରେ ଶୁଣାଣି ନ କରି ପୀଡ଼ିତାଙ୍କ ପରିବାର ପ୍ରତି ଅନ୍ୟାୟ କରାଯାଇଛି। ଅଭିଯୁକ୍ତ ଛୋଟକାଉ ହେଉଛନ୍ତି ଉତ୍ତରପ୍ରଦେଶ ଶ୍ରାବସ୍ତି ଜିଲ୍ଲାର ଜଣେ ଗରିବ ଲୋକ। ସେ କହିଛନ୍ତି ଯେ ତାଙ୍କର କିଛି ଦୋଷ ନାହିଁ। ମାର୍ଚ୍ଚ ୮, ୨୦୧୨ର ଦୁଷ୍କର୍ମ-ହତ୍ୟା ମାମଲାରେ ତାଙ୍କୁ ଗାଁ ମୁଖିଆଙ୍କ ସ୍ବାମୀ ଫସାଇ ଦେଇଛନ୍ତି। ସେ ତାଙ୍କର ସମ୍ପର୍କୀୟ ଏବଂ ତାଙ୍କ ମାଆଙ୍କ ସମ୍ପତ୍ତିକୁ ହଡ଼ପ କରିବାକୁ ଚାହାନ୍ତି। କୋର୍ଟ ମଧ୍ୟ ଅନୁଭବ କଲେ ଯେ ଛୋଟକାଉ ଅତ୍ୟନ୍ତ ଗରିବ। ସେ ନିଜ ସପକ୍ଷରେ ଲଢ଼ିବା ପାଇଁ ଓକିଲଟିଏ ବି ଦେଇପାରି ନାହାନ୍ତି। ବହୁ ଅନୁରୋଧ ପରେ ତାଙ୍କୁ ଜଣେ ସରକାରୀ ଓକିଲ ଯୋଗାଇ ଦିଆଯାଇଥିଲା। ଏପରି କ୍ଷେତ୍ରରେ କୋର୍ଟଙ୍କ ଦାୟିତ୍ବ ଗୁରୁତ୍ବପୂର୍ଣ୍ଣ। କିନ୍ତୁ ବିନା ପ୍ରମାଣରେ ତଳ କୋର୍ଟ ୨୦୧୪ ମାର୍ଚ୍ଚ ମାସରେ ଛୋଟକାଉଙ୍କୁ ମୃତ୍ୟୁଦଣ୍ଡାଦେଶ ଦେଇଥିବା ବେଳେ ୨୦୧୬ ଏପ୍ରିଲ ମାସରେ ଆଲ୍ଲାହାବାଦ ହାଇକୋର୍ଟ ଏହାକୁ କାଏମ ରଖିଥିଲେ।
ଶେଷରେ ଛୋଟକାଉଙ୍କ ମାମଲା ଅବସରପ୍ରାପ୍ତ ହାଇକୋର୍ଟ ଜଜ୍ ଏସ୍ ନାଗମୁଥୁଙ୍କ ନଜରକୁ ଆସିଲା। ସେ ତାଙ୍କ ସପକ୍ଷରେ ସର୍ବୋଚ୍ଚ ଅଦାଲତରେ ଯୁକ୍ତି ଉପସ୍ଥାପନ କଲେ। ଶୁଣାଣିରେ ରହିଥିବା ବ୍ୟତିକ୍ରମ ଓ ବିରୋଧାଭାସଗୁଡ଼ିକୁ ସେ ଧରାଇଦେଲେ
